Terms of Service.
How we work together, from deposit to final files. Plain language, no surprises.
These terms apply to every project you book with GIG Graphic Designs Inc. ("GIG," "we," "us"), owned by Nicole D. Bradley. By paying a deposit, submitting an intake or planning guide, or signing a service agreement, you ("Client") agree to them. If you sign a separate written agreement, such as a Retainer Agreement or Website Agreement, that agreement controls where it differs from these terms.
1. Services
We create graphic design and digital content for events, small businesses, non-profits and churches. This includes flyers, social media graphics, digital screens and overlays, program books, conference packages and websites.
Unless a package says otherwise, our services do not include video production or fully custom publications, such as magazines, catalogs or annual reports. Printing is quoted separately by the printer, and we are happy to refer you to one. Website projects are covered by a separate agreement.
2. Quotes and pricing
Prices are listed on our website. Website Launch and Program Books are starting prices. Your final price is confirmed in a written quote or agreement after we review your intake or planning guide.
Prices may change for new projects, but never for work already quoted and accepted.
Third-party costs, such as stock images, fonts, shipping, ad fees, domains or plugins, are billed separately. We will get your approval before buying anything on your behalf.
3. Deposits and payment
A 50% deposit is required before work begins. One and Done flyers are paid in full up front. The deposit reserves your spot in our schedule. All deposits are non-refundable.
The remaining balance is due by the midpoint of your project, when your first proof is ready. We send an invoice at that point, and revisions and final files follow once it is paid. Installment plans are available when agreed in writing.
We accept credit cards.
If a payment is overdue, we may pause work, hold final files, or deliver files with a "PROOF" watermark until the balance is paid.
4. Timelines
Your project timeline starts once we receive your deposit and all required materials (text, photos, logos, dates and details). First drafts arrive within 3 to 5 days after that. Websites and larger program books get their timeline in your quote.
Please review proofs and reply within 48 hours. If a project is delayed more than 15 business days because we are waiting on you, we may move it to the next open spot in our schedule.
Rush service is available for an added agreed-on fee when our schedule allows.
5. Revisions
Revisions are unlimited within the original scope of your project. A revision is a change to the approved concept, such as wording, colors, photos or layout.
A new concept, a new size, or new content after approval counts as a scope change. Retainer clients get free resizing to 16:9, 9:16 and 1:1, and those resizes do not count toward their monthly designs. Scope changes must be agreed in writing and may be quoted separately.
6. Client responsibilities
You confirm that you own, or have permission to use, every photo, logo, text and other material you send us. You agree to cover any claim that arises from materials you provide.
You are responsible for proofreading. Once you approve a final proof, we are not responsible for errors in names, dates, spelling or details that appeared in the approved proof.
7. Ownership and use of work
When your balance is paid in full, you own the final files we deliver to you. Your domain and website content also stay yours, even if you leave.
GIG keeps ownership of drafts, unused concepts and working source files (such as layered Adobe files) unless you buy them in writing for an added agreed-on fee.
We may show finished work in our portfolio, website and social media. If your project is confidential, tell us in writing before work begins and we will not share it.
8. Websites, hosting and small updates
Website Launch starts at $497. Your final quote comes after we review your Website Planning Guide.
Hosting and small updates are $97 per month, starting one month after your website launches. This covers hosting, security updates and small content changes on request, such as updating text, photos or dates. Small updates are unlimited.
New pages, new features and redesigns are not small updates and are quoted separately.
You may cancel the monthly plan with 30 days' written notice. When you cancel, we give you a copy of your site content and help move your domain, because both stay yours. Your domain is registered in your name, and you pay domain fees directly to the domain company.
9. Retainers and packages
Monthly Retainers come in four lengths: Seed (1 month), Sprout (3 months), Bloom (6 months) and Harvest (12 months). Every retainer includes:
- Up to 15 designs per month
- Revisions within 10 hours
- Unlimited revisions while a design stays within the original scope
- Free resizing for widescreen (16:9), stories (9:16) and square posts (1:1). Resizes do not count toward your 15 designs.
- Flyers, posters, banners, social graphics, livestream overlays, tees, programs and more
- A custom brand template built around your logo, colors and fonts
- Programs and booklets: 4 pages count as 2 designs and 8 pages count as 4 designs
Unused designs do not carry over. They expire at the end of each month, with no refund or credit. Websites are not part of a retainer and have their own agreement. Your signed Retainer Agreement gives the full details.
10. Cancellations and refunds
All deposits are non-refundable.
If you cancel after work has started, you pay for work completed to that point. Payment is due within 10 business days of the final invoice.
Either party may end a retainer with 30 days' written notice. Fees for services already delivered are not refunded.
See our Fulfillment Policy for refunds by package.
11. Limits of liability
Our total liability for any claim is limited to the fees you paid for the project involved.
We are not responsible for indirect losses, such as lost profits, lost event attendance or printing costs from an approved proof.
We are not liable for delays caused by events outside our control, such as illness, outages, natural disasters or emergencies.
12. Confidentiality
We keep your business information private and use it only to complete your project.
13. Disputes
If a disagreement comes up, we will first try to resolve it together for 30 days. If that does not work, we will use mediation in Suffolk County, New York, through the American Arbitration Association or the Suffolk County Community Dispute Resolution Center. Mediation fees are split equally.
14. Governing law
These terms are governed by the laws of the State of New York.
15. Notices and signatures
Notices may be sent by email. An email sent after 5:00 p.m. Eastern counts as received the next business day. Electronic signatures and online acceptance are as binding as handwritten signatures.
16. Changes to these terms
We may update these terms. Changes apply to new projects booked after the update date shown above.
